Community Care

The Mental Capacity Act came into effect on 1st October 2007 introducing a new framework of decision making for adults who may lack the capacity to make decisions for themselves. The Act sets out a new jurisdiction for the Court of Protection to make declarations as to capacity and decisions in relation to personal welfare, health care and finance based on the principles of welfare and best interests.

 

It is a natural progression for 4BC to utilise their expertise in public law children work to expand into this new area of law that protects vulnerable adults. The Act has a wide scope and will impact on anyone who may have dealings with a person who lacks capacity, both in a professional and personal capacity.
