Comment

George Paterson represented the Local Authority in the Court of Appeal in support of a successful appeal by the Children’s Guardian against the BBC for permission to report on historic care proceedings.

The Lady Chief Justice, alongside Lady Justice King and Lord Justice Warby found that the original decision by a High Court Judge regarding the open justice principle was incorrect as it had allowed the disclosure of information from outside of the court sphere, and not connected to the open justice principle.

The Court of Appeal ruled that care proceedings are not always an ‘available source of material for journalistic endeavour.’
