Comment

Within proceedings concerning the financial arrangements following separation, the wife sought a declaration of marital status under section 55(1)(a) of the Family Law Act 1986.

The applicant asserted that there had been a customary marriage ceremony in Lagos, Nigeria, in1977. The respondent denied that any such ceremony had taken place. In the alternative it was asserted on his behalf that any such ceremony would have been void in any event as it would have been a polygamous marriage entered into at a time when he was domiciled in this jurisdiction.

The case involved 1300 pages of documentation, including no less than eight statements by the applicant, five statements by the respondent and a further thirty-four statements from third parties.
