  • Opposing return of children to jurisdiction

    The Court of Appeal recently ruled in an appeal in which two members of chambers appeared. Marianna Hildyard QC and Kieran Pugh represented the mother and successfully appealed against the decision of a Section 9 Judge who had ordered the return of a child lawfully removed from the jurisdiction.

  • Standard of Proof in Care Proceedings

    The House of Lords ruled on 11th June 2008 in an appeal in which three members of  4 Brick Court Chambers appeared before their Lordships on 19th and 20th May 2008. Marianna Hildyard QC and Isabelle Watson represented the Respondent father and Stuart Fuller (led by Stephen Cobb QC of 1 Garden Court Chambers) represented the Appellant children (through their Children’s Guardian). CAFCASS intervened.

Domestic Violence 

Barristers at 4 Brick Court have a wealth of expertise in domestic violence law. Specialist members frequently appear for Applicants and Respondents in Family Law Act 1996 matters including applications for Non-Molestation Orders, Occupation Orders and Committal proceedings. In addition, members are experienced in dealing with issues of domestic violence in both private and public Children Act work.

 

4 Brick Court is known for offering a skilled and sensitive approach to this difficult area of law and specialist members are highly regarded for their ability to put clients at ease whilst providing robust representation.

 

A number of 4 Brick Court’s members were trained by His Honour Judge Platt in the amendments to the Family Law Act 1996 set out in the Domestic Violence Crimes and Victims Act 2004 that came into force from 1 July 2007. Chambers has a detailed knowledge of all aspects of this legislation and has broad experience of the varying forms of implementation. In particular, members have benefitted from appearing at the Specialist Integrated Domestic Violence Court sitting at Croydon which is one of two courts in a nationwide pilot scheme.

 

Instructions are accepted from women’s aid charities and organisations as well as high street law firms. Members engage in pro bono work on behalf of victims of domestic violence and have written, lectured and trained on all areas of domestic violence work. Our barristers are also able to assist clients with advice on accessing a wide range of domestic violence support groups.
